Terms and conditions

This document establishes terms and conditions (the “Terms”) governing the binding agreement between the customer (hereinafter referred to as “Customer”) and the seller (hereinafter referred to as “1 ZULF OÜ”) of the website www.zufil.ee (the “Website”).

1. Terms of sale

1.1. The following terms and conditions apply to all goods/services offered and sold through this Website (the “Products”), and any orders placed through the Website by the Customer with www.zufil.ee
1.2. In addition to these terms and conditions, 1 ZULF OÜ regulates products from the online store In the Republic of Estonia, the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation.
1.3. 1 ZULF OÜ reserves the right to amend these Terms without prior notice. The version of the Terms that will apply to your order will be those on www.zufil.ee at the time you place your order.
1.4. All reasonable efforts are made to accurately display the attributes of the Products, however, the images of the Products on the Website are for illustrative purposes only, therefore the Products attributes may differ from the displayed images.
1.5. 1 ZULF OÜ is entitled to withdraw from the purchase contract without
penalty and not to deliver/provide the Products in the following cases:
a) in case of running out of stock
b) in case of bugs that have affected the Product’s attributes or price in
the system
c). in any case when the Customer does not meet the requirements
established by 1 ZULF OÜ

If for any reason 1 ZULF OÜ is unable to fulfil the order, the Customer will be notified at the earliest opportunity. If the payment for such order has already been received, the applicable amount will be refunded.

2. Prices

2.1. All monetary amounts specified in these Terms are in Euros (EUR).
2.2. Promotions are only available for a limited time only, for as long as it is advertised
on the Website.
2.3. Discounted prices of the Products during promotions are displayed on the Product’s
website.
2.4. All promotional codes are applied to the value of the order and are limited-time offers. The discounted cost of the Products will be displayed at the latest on the checkout process.
2.5. The prices displayed at the Website do not include a delivery charge. The total cost of the order is the price of the Products ordered plus the delivery charge. The cost for each delivery method is clearly indicated during the checkout process.
2.6. The purchase price shall apply from placing the order to expiry of the payment period (not later than within 2 days of placing the order).
2.7. Payment may be made using the following payment options: prepayment bill by bank transfer; payment link; Visa, MasterCard, Maestro card.
2.8. Promotional offer price may also apply from a certain total order amount when the Customer is offered free or discounted delivery method. After choosing the delivery method discounted price will be displayed at the latest on the checkout process.

3. Placing the order

3.1. Pick a Product from the Website and add to shopping cart.
3.2. Go to the shopping cart by clicking the ‘Check out’ button at the top of the screen.
3.3. To place the order choose a delivery method for the Products.
3.4. The shopping cart will be retained when leaving the shopping cart page.
3.5. After choosing the delivery method tick “I agree to the Terms and Conditions” box and to continue press “Payment” button.
3.6. After providing personal data press “Order overview” button.
3.7. Promotional codes must be entered after pressing the “Got a voucher or coupon” button during the checkout process. To apply the code press “Apply” button. All promotional codes are case specific. The terms and conditions related to promotion code usage are stated in the Terms of the promotional offer. Promotional codes include discount percentage from the total amount of the order, free delivery, fixed amount of discount, etc.
3.8. For order confirmation choose the method of payment: prepayment bill by bank transfer; payment link; Visa, MasterCard, Maestro card.
3.9. Placed orders on the Website are processed every day from 12.00 to 18.00.

4. Entering the purchase contract

4.1. 1 ZULF OÜ undertakes to hand over to the Customer the Products that are existing, manufactured or will be acquired by 1 ZULF OÜ in the future and to ensure the transfer of ownership to the Customer. The Customer undertakes to make a payment for the order in full amount to the bank account of 1 ZULF OÜ and accept the order.
4.2. 1 ZULF OÜ is entitled to cancel the order after 5 days if the payment for the order in full amount to the bank account of 1 ZULF OÜ has not been received.
4.3. The Customer and 1 ZULF OÜ have entered the purchase contract after the payment for the order in full amount to the bank account of 1 ZULF OÜ is received.

5. Delivery

5.1. After confirmation of an order the Products can be received in the following
delivery methods:
a) the order will be sent to the chosen address of Itella SmartPOST indicated in the checkout process,
b) the pick-up option by prior agreement.
5.2. 1 ZULF OÜ aims to deliver the Products within Estonia within 1-5 business days following confirmation of an order.
5.3. Expected delivery details on the Website are valid from the moment the payment for the order in full amount is received to the bank account of 1 ZULF OÜ.
5.4. For prompt delivery, ensure that the provided personal data is accurate, complete, and up to date.
5.5. 1 ZULF OÜ aims to deliver within the communicated time frame unless the unexpected events beyond 1 ZULF OÜ’s reasonable control occur. In that case, 1 ZULF OÜ is not responsible for the delay.
5.6. In the unlikely event, the delivery time may take up to 45 days.

6. Returns

6.1. Purchased Products can be returned and the order cancelled within 14 days of the order being delivered to the Customer. The 14-day right of cancellation does not apply to legal entities.
6.2. The returned Products must be new, unworn, unwashed, and unaltered with all internal garment tags intact and sent back in the same package received with all of the initial contents. If an additional Product was added to the package of the purchased Product, all of the received packages’ contents must be returned. Please include with the product being returned all original boxes, instructions, documents, and wrappings.
6.3. If the Products to be returned deteriorate, the Customer is responsible for the decrease in value. In order to ensure all of the initial attributes of the Product unaltered, the Customer agrees to handle and use the Products only as normally allowed in the physical stores.
6.4. To meet the cancellation deadline it is sufficient for the Customer to send the communication to 1 ZULF OÜ’s email support@zufil.ee before the 14 days´ cancellation period has expired.
6.5. The Products being returned must be received by 1 ZULF OÜ within 14 days after the cancellation communication or the Customer must provide evidence of having handed over the Products to the courier within the mentioned period.
6.6. 1 ZULF OÜ will reimburse all payments received from the Customer for the Products purchased including delivery charges for the least expensive type of delivery offered by 1 ZULF OÜ within 14 days from the day on which the Customer communicates the return and cancellation of purchased Products.

7. Liability

7.1. 1 ZULF OÜ will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations that are caused by any act or event beyond 1 ZULF OÜ’s reasonable control.

8. Personal Data Processing

8.1. With a view to making the Client’s personal data available to 1 ZULF OÜ, the Customer hereby agrees to the processing of the Customer’s personal data in accordance with the Terms. Personal data includes first and last name, telephone number, delivery and/or home address, email. Personal data will be forwarded to third parties to provide the Customer with 1 ZULF OÜ’s services.
8.2. 1 ZULF OÜ has the right to use Customer’s personal data to provide the Customer with important information and updates pertaining to the order, in addition to send occasional company news, updates, related Product or service information, etc.
8.3. The Customer has the right to restrict or object, at any time, to the further processing of the Customer’s personal data. There are instances where applicable laws or regulatory requirements allow or require 1 ZULF OÜ to refuse to provide or delete some or all of the maintained personal data.
8.4. Encrypted data transmission with banks ensures the security of sensitive/credit information which is not accessible by 1 ZULF OÜ.

9. Complaints

9.1. 1 ZULF OÜ is responsible for the non-compliance with the Terms or defect of the Product which already existed at the time of delivery of the Product to the Customer and which becomes apparent within two years from the delivery of the Product to the Customer. From the mentioned two year period the first six months are presumed to already have an existing defect of the Product. 1 ZULF OÜ’s obligation is to rebut the respective presumption.
9.2. The Customer has a right to communicate 1 ZULF OÜ about defective Product within two months through email support@zufil.ee or by the telephone number +372 58127490.
9.3. 1 ZULF OÜ is not responsible for defects that have occurred after the customer had received the Products.
9.4. 1 ZULF OÜ will respond to the Customer’s complaint in a written or reproducible way within 15 days.
9.5. If the Products purchased from the Website found defective and 1 ZULF OÜ is responsible for the faulty Product, the Products will be repaired or replaced. In case the Products can not be repaired or replaced, 1 ZULF OÜ is accountable for reimbursing all payments received from the Customer for the Products purchased.

10. Resolving disputes

10.1. Any complaints regarding the services provided on the Website should be contacted through email support@zufil.ee or by the telephone number +372 58127490.
10.2. If the Customer and 1 ZULF OÜ are unable to resolve the dispute by an agreement, the Customer has a right to turn to the Consumer Disputes Committee. The terms of the procedure can be found and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the Customer and 1 ZULF OÜ. Reviewing the Customer’s complaint in the Committee is free of charge. The Customer has the right to turn to the European Union Consumer Dispute Resolution Platform.
